Terms & Conditions - A wish for happiness
• Identity - This promotion is organised by Rituals Cosmetics Enterprise B.V., having its registered offices at Keizersgracht 679, 1017 DV Amsterdam, the Netherlands, and registered with the Chamber of Commerce under number 809215160 ("Rituals").
• What is #awishforhappiness - The #awishforhappiness is a promotion that enables you to win the wish of your loved one to be fulfilled. The promotion will run from 2nd October (at 00:01 GMT) up to and including 15th October (at 23:59 GMT) for the first winner and up to and including 31th October (at 23:59 GMT) for 3 additional winners ("Promotion Term").
• Who can participate? - This promotion is intended for all people aged 18 or above. If you are under the age of 18, you are not eligible to participate in this promotion. Once a person has completed the requirements for participation, as set out below, they will become a participant ("Participant").
The following parties are excluded from participation: (I) employees of Rituals or companies affiliated or associated with Rituals, (II) every other person who is involved in the organisation of the promotion, and (III) immediate family members of the persons mentioned under (I) or (II).
• How to participate - Participation is free of charge. To be eligible for winning a prize, a Participant must post his/her wish for a loved one on Instagram using #awishforhappiness @ritualscosmetics during the Promotion term. The wish must be realizable and the Participant makes sure that his/her loved one will accept the wish. A wish with unlawful content or content that violates applicable regulations or content that is eligible to insult, defame, harass or otherwise harm other individuals, is not admissible.
• Prize & the determination of winners – The most beautiful wishes will be selected by an independent jury on the 16th of October (first winner) and on the 31th of October (additional 3 winners).
The wish of the first winner with a maximum value of 10.000 euro will be fulfilled and filmed before 18/12/2019 and possibly featured in a short documentary which Rituals will spread on: Instagram, Facebook, Linkedin, Youtube paid and unpaid during Christmas from 23/12/2019 – 25/12/2019. 3 additional wishes with a maximum value of 3.333 euro each will be fulfilled before 01/01/2020. ("Prizes"). We will ask the winners to capture some short video’s which we will post on stories @ritualscosmetics. Everyone who is visible in these video’s has given permission.
The lucky winners will need to provide their email address, contact phone number and home address as instructed at the time of being announced as the winner. Further details will then be provided by Rituals. All persons featured in the film will need to sign a quitclaim and will not be financially compensated for their participation.
All Prizes under this promotion are strictly personal, non-transferable, and non-exchangeable for cash or any other form of compensation.
The winner will have 48 hours to claim their prize from the date that they are announced as a winner. After this time Rituals reserves the right to select a new winner.
• Privacy – By participating in the promotion, Rituals will use Participants' and loved ones' personal data collected solely for the purposes of running the promotion and in relation to the Prize. Personal data will not be further used or retained by Rituals for any other purposes, unless Participants or loved ones’ consented thereto. • Liability - Subject to Rituals' willful misconduct or gross negligence and to the maximum extent permitted by law, Rituals is only liable for direct damages caused due to Rituals' negligence and not for any indirect damages, loss of profits or business interruption (even if Rituals have been advised of the possibility of such damages or such damages are foreseeable) arising out of the Participant's participation in the promotion. As such, Rituals is not liable for any damage arising from not being able to participate or being excluded from the promotion, for whatever reason, and/or the suitability of, a defect in or the non-conformity of the Prize.
• Exclusion – Rituals reserves the right to exclude any entries which believe to be inappropriate, fraudulent or based on misconduct.
• Applicable law - To the extent allowed by law, this promotion is governed by the laws of the Netherlands, and all disputes in relation to the promotion that cannot be settled amicably will be placed exclusively before the competent courts in Amsterdam. This choice of law does not deprive you of the protection afforded to you under your own laws where such provisions that cannot be derogated from by agreement by virtue of the law of your jurisdiction.
• Applicability - By participating in the Promotion the Participant agree to these Terms and Conditions.
Rituals reserves the right to withdraw or amend without notice this promotion in the event of any unforeseen circumstances outside of its reasonable control.
